1.1. We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an e-mail to you at the e-mail address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us.
1.2. The prices payable for goods that you order are as set out in our website.
1.3. The formation, existence, construction, performance, validity and all aspects of the contract between us shall be governed by English Law and you and NaturalFigures Limited shall submit to the exclusive jurisdiction of the English courts.

NaturalFigures Limited does not represent or warrant that the information provided on this website is accurate, complete or current. NaturalFigures Limited shall not be liable to any person for any loss or damage, which may arise from the use of any of the information contained in any of the material used in this website. Prices and product availability information may change at any time without notice and it is the users responsibility to check whether any such changes have been made.

4.3. The information we collect:
Your name, telephone number, home & delivery address and email address, which we collect when orders are placed. We do not receive any credit/debit card details. All payments are processed by Protx secure service providers.
4.4. What the information is used for:
We will use this information to process orders, for promotional activity, and to keep you updated in changes operated within the website. If you agree to use of your information, please tick the relevant box when submitting your details and we will send you newsletters via email advising you of forthcoming special offers and promotions. A facility is available for you to unsubscribe at any time.

5.1. Shopping at NaturalFigures.co.uk is completely secure. We do not receive any credit/debit card details. All payments are processed via Protx secure service providers. Protx provides very high levels of internet and physical security to ensure sensitive information is never compromised.
5.2. Protx security measures:
- Credit/debit card details are secured with a 128-bit encrypted sessions.
- Sensitive information is stored on a heavily encrypted database that is protected by multiple government approved firewalls.
- Additional security measures including a security key that is used to produce MD5 hash value. Hash values are often used as digital signatures as they cannot be reversed to obtain the original information. They allow the receiver to validate that the information received is identical to that sent.
6. Accounts and Passwords
6.1. When placing an order with NaturalFigures we will ask you to set up an account. Your account will contain your name, delivery details, email address and a record of your orders. To make amendments to your account you will need your email address and password. If you are a new customer and want to create an account, click on the My Account button and follow the on screen instructions.
6.2. If you are a returning customer, click on the My Account button, enter your email address and password. If you have forgotten your password, don't worry just click on password forgotten, you will then be sent an email containing your password. Please note that your password is confidential and will only be seen by you.
6.3. Please note that we do not store your credit card details online.
8. Intellectual Property, Trademarks & Copyright
8.1. All contents including website design, graphics, text and images are owned or licensed to NaturalFigures Limited. Any use of the site or its contents, including copying or storage in whole or part, other than for personal use is strictly prohibited.
8.2. NaturalFigures is a registered trademark of NaturalFigures Limited in the UK and other countries. Other product and company names mentioned on our website may be the trademarks or registered trademarks of their respective owners.

All orders for products are subject to availability. Our interactive stock control system will only allow you to order items for immediate despatch. In the unlikely event that an item is found to be out of stock, you will receive an email notification and payments will be reimbursed in full ASAP. We will not be obliged to offer any additional compensation for disappointment suffered.
We aim to despatch all items as soon as possible subject to payment clearance & stock availability.

10.2. Prices on our website are shown in GBP. If you require an alternative currency click onto the currency converter button, displayed on the right hand corner of every page. Please note that prices shown on the website in US Dollars and Euro are only a guide, and may differ slightly when you go to the checkout, this is due to the exchange rate.
11. Stock Availability
11.1 All orders for products are subject to availability. Our interactive stock control system will only allow you to order items for immediate despatch.
Should an item be indicated out of stock, it is on order from the manufacturer and should be available shortly.
Sale items have limited stock availability and will not be replenished, when they are gone, they're gone, so buy it now to avoid disappointment.
12. Order Cancellations
12.1. Under the United Kingdom Distance Selling Regulations you have the right to cancel the order/contract for any reason at any point from the time of ordering until seven working days after delivery. Cancellation of an order must be made in writing, quoting your order/invoice number, within 7 working days of the delivery of your item(s), and can be sent by email to customerservices@NaturalFigures.co.uk. Once you have cancelled your order you must return the goods to us immediately at your own cost see Returns, Exchange and Refunds for details. The item is your responsibility until it reaches us. For your own protection when returning an item, we advise that you get proof of postage and insurance to cover the value of the goods. We will let you know as soon as we receive the goods, and will then process your request for either a refund or replacement as quickly as possible.
12.2. If we have already shipped your order by the time you notify us of your wish to cancel, please return the item immediately (see Returns, Exchange and Refunds for details of how to return). We will contact you as soon as we receive the goods, and will process your request as quickly as possible.
12.3. Customers must return the goods in the event they cancel the contract. If you fail to return the goods we may arrange for collection of these goods from your residence at your cost. These costs will be deducted from your refund. Your refund will be processed within 30 days at the latest, after we receive your notification.
13. Returns / Exchange & Refunds
13.1. NaturalFigures.co.uk offers you a 100% guarantee that if you are not completely satisfied with your goods, we will exchange them or give you a refund minus the initial postage costs. If you selected free first class delivery, £1.95 will be deducted from your refund, please note the item must be returned in it's original condition & packaging, unworn and unwashed with all labels intact. Goods must be returned within 14 days of receipt, the item is your responsibility until it reaches us, we therefore advise that you request proof of postage. Please note that there will be a fee of £1.95 to exchange an item for any reason. This is to cover administration and postage/packaging fees, as the initial postage/packaging fees are free. Please enclose a cheque or postal order for £1.95 when exchanging an item.
13.2. Please ensure that briefs / thongs / swimwear etc. are tried on over your own underwear. Also when trying on lingerie / swimwear please ensure that you are not wearing perfume or deodorant which may leave scent or marks on the item. We will not be able to accept the return of any item where there is evidence that these instructions have not been followed. Some products are non-returnable for hygiene reasons (unless the item is found to be faulty). These products are clearly marked with 'NR' within the product information. These conditions do not affect your statutory rights.
13.3. Returning Instructions:
- Complete the returns slip on the reverse of the invoice (ticking appropriate box)
- Tear off slip (retaining the invoice for your own records)
- Package the item (in original packaging, with labels intact) including returns slip and payment for exchange if applicable.
- Returns address is at the top right hand corner of the invoice page 1.
- Post the item to us by visiting your local post office, the item is your responsibility until it reaches us, we therefore advise that you request proof of postage.
- We will let you know as soon as we receive the goods, and will then process your request for either a refund or exchange as quickly as possible.
- For International Returns, clearly mark on the package Returned Goods to avoid delays at customs.
13.4. Returning goods for which duty has been paid
If for any reason you wish to return goods that you have paid duty on, it may be possible for you to claim a refund on duties that you have paid. To make a claim contact your local customs authority.
14. Faulty / wrong item
14.1. If the item you received is faulty or not what you have ordered, you are entitled to a refund or replacement. Please email customerservices@NaturalFigures.co.uk quoting your order/invoice number, your name and address, details of the product and the reason for the return, and whether you require a refund or a replacement.
15. Delivery / Shipping time & cost
15.1 We aim to despatch all items as soon as possible (but in any event 30 days of the order) subject to payment clearance & stock availability. We will arrange delivery of the goods ordered by you to the address you give us for delivery at the time you make your order.
Orders will be sent in plain packaging. Please note that for delivery purposes our return address will be shown in one corner of the address label.

15.2. For UK deliveries
If you are not in at the time of delivery of your package, or the package is too large to fit through the letterbox. Don't worry! The postman will leave a card asking you to collect your package from your local post depot (You will need to take proof of identification and the card to collect your item). If you are unsure contact the courier direct.
15.3. Please note that where a signature is required orders will not be sent to PO box addresses.
15.4. For Worldwide deliveries
All deliveries will be made according to the courier's standard procedures.
15.5. You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
16. Customs & Duty
16.1. Deliveries outside the UK may be subject to import duties or taxes.
16.2. Any customs or import duties are levied once the package reaches its destination country. Additional charges for customs clearance must be borne by the recipient. We have no control over these charges and cannot predict what they may be. Customs policies vary from country to country; you may want to contact your local customs office for further information.
16.3. Please note it is a legal requirement that we declare the full value of the goods on all packages mailed outside the European Union. There will be a customs sticker on the reverse of the package declaring the full value and contents of the package.
16.4 Returning goods for which duty has been paid
If for any reason you wish to return goods that you have paid duty on, it should be possible for you to claim a refund for duties that you have paid. To make a claim contact your local custom authority.
17.1. All items shown are inclusive of VAT @ 17.5%
Orders outside the UK are not subject to VAT. All NaturalFigures customers pay the same prices throughout the world, to help cover additional costs for providing a service to international customers.
18.1. If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 10 working days of the delivery of the goods in question.
18.2. If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 40 days of the date on which you ordered the goods. If you notify a problem to us under this condition, our only obligation will be, at your option:
18.2.1. to make good any shortage or non-delivery;
18.2.2. to replace or repair any goods that are damaged or defective; or
18.2.3. to refund to you the amount paid by you for the goods in question in whatever way we choose.
18.3. Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause 18.2.3. above.
18.4. You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
18.5.1. Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
19.1. Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address at NaturalFigures Ltd, Harmony House, 34 High Street, Aldridge, Walsall, West Midlands WS9 8LZ. All notices from us to you will be displayed on our website from to time.
19.2. We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
19.3. If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
19.4. Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
